Terms & Conditions of Use

Welcome to the AptShopper.com & SBAA Job Board (“Job Board”). Please read these Terms and Conditions of Use governing usage of this Job Board and its contents before proceeding further as your Usage of the Job Board is contingent on your acceptance of such. By clicking the "I ACCEPT" button you agree to honor and accept the terms and conditions expressed herein and to abide by them. These Terms of Use must be accepted for unregistered users and users registering accounts. By accessing and using the Job Board, you agree to comply with these Terms of Use. Additionally, if you are using the Job Board on behalf of a company or other legal entity, then "you" also means such company or legal entity and you agree to be bound by these Terms and Conditions of Use.

1. The Job Board as well as its posts, information, forms, email and contact forms, and mobile applications is a wholly-owned product of Kilé Publishing, Inc. (“Publisher”). The Job Board is hosted and maintained by the website of Publisher, AptShopper.com (website for The Shreveport-Bossier Apartment Shoppers Guide), and is advised and collaborated with by The Shreveport-Bossier Apartment Association (“SBAA”). Publisher, AptShopper.com and SBAA are herein together referred to as the Provider (“Provider”).

2. Users
a. The Users (“Users”) of the Job Board include visitors (“Visitors”), job seekers (“Job Seekers”), and employers (“Employers”). Users will post information and view information posted by other Users, contact other Users (either directly or by the forms on the Job Board), and may be communicated to by other Users by the email forms on the Job Board as well as by personal outreach by external methods. Users shall exercise common sense and courtesy when using the Job Board, and it is prohibited for any User to post information that contains defamatory, disparaging, obscene, or offensive remarks or materials, as well as any references or phrases referring to religious or political beliefs, discriminatory words, or other distinctions that deal with the nationality, sex, or any statements that may insult the personality of other Users. Additionally, all information posted by Users is deemed by Provider to be correct and accurate, and it is the responsibility of User posting the information and other Users reading the information to verify such posted information’s authenticity. Furthermore, Users are prohibited from uploading or distributing any information subject to trademark, copyright, or other proprietary rights except with the express consent of the owner of the rights. As such, each User hereby agrees to release, indemnify, and hold harmless, the Provider and Job Board from any negative outcome or liability resulting to that User from inaccurate information, deceit, or other contact from or with other Users utilizing the forms or information on the Job Board.

b. Users who register accounts, complete Job Seeker Listings, post Job Opportunity Listings, or respond to Listings on the Job Board through the provided email forms or provide other information to the Job Board, may be providing personal, confidential, and potentially sensitive information to the Job Board. Users are aware and agree that such information will be stored on the Job Board, and that although such provided information is considered as sensitive personal data, it will not be considered as confidential information. As such, each User agrees that the information it provides or posts on the Job Board or through the email forms is likely to be communicated to one or more Users or other third parties, and may be considered as public information, depending on the privacy settings User has selected on the Job Board. In any scenario or privacy settings selected by the User, should a User have any doubts relative to the above statements, that User is advised not to submit such confidential information to the Job Board or to not utilize the Job Board in that employment hunt or job candidate search.

c. The Job Board is not to be accessed to conduct any illegal or unscrupulous activities. For example, the Job Board shall not be used to encourage software infringement, spreading of computer viruses, breaking into private computer forums, gambling, or other crimes.

d. Users may provide their passwords to third parties, but only with the expressed prior written consent of Provider. Additionally, Users shall respect the security of the Job Board and shall not attempt to delete or revise material posted by any other User or to gain access to areas private to Job Board or other Users.

e. While the Provider and the Job Board intends to solely display legitimate and accurate Job Seeker Posts and Job Opportunity Posts by legitimate Employers and Job Seekers within the property management community, the Provider is not responsible for negative consequences incurred by the inaccuracy or illegitimacy of supposed job opportunities, Job Seeker identities and/or the contact information for Users of the Job Board. The inclusion of listings, links or information on the Job Board does not constitute an endorsement of the Employer, recruitment agency, Job Seeker or a guarantee that a job opportunity or a particular Job Seeker even exists. As such, it is the responsibility of the Users to verify the accuracy and authenticity of any information posted on the Job Board or items provided to them by other Users. Users will need to use their own best efforts to confirm such posted information and should use caution when contacting Users of posted listings while such verification is performed.

f. Additionally, it is up to each User to verify the information in each Listing it has posted is displayed correctly and as intended on the Job Board. Provider takes no responsibility, makes no warranty, nor assumes any liability for the accuracy of such information as displayed on the Job Board to Users, either erroneously or by technical errors of the User, Job Board, hosting company, Internet Provider (IP), or the Provider. If the information posted or provided by a User is displaying incorrectly, that User should contact the Provider immediately so the issue can be addressed.

g. The posting of derogatory, illegal or other negative information by a User is the liability and responsibility of that User posting such information and is not the liability or responsibility of Provider. The Provider reserves the right (but not the obligation) within its sole discretion to delete such posted listings, information, or announcements.

h. Users may not use the Job Board for purposes other than presenting the specific job positions as well as seeking for suitable and interested candidates' professional profiles. This Job Board is for informational usage only and nothing contained within should be construed by Users to represent any kind of warrantee, agreement, or contract between individual Users and/or Users with the Provider. Users are urged to utilize their existing external profiles, resumes, job applications and other employee forms when communicating or applying for jobs with each other.

i. Upon pressing the "I ACCEPT" button, Users are bound not to make any illegal use of the site, including not to use the site to commit crime, offend rights, and offend intellectual property rights. In particular, Employers undertake the obligation to comply with the legislation in force dealing with the finding of personnel, advertising, and protection of personal data.

j. Users may interrupt or cancel their account at any time.

k. Removal of Obsolete Listings. It is the responsibility of the User to edit or remove any Job Seeker Listings, Job Opportunity Listings or other related forms or information at such times as such information is out of date, the job opportunity is filled or the Job Seeker is no longer looking for employment.

3. Job Seekers
a. Job Seekers (and Visitors) are granted a limited, terminable, non-exclusive right to utilize this Job Board for the sole purpose of seeking employment, replying to Posted Job Opportunity Listings by potential employers, posting Job Seeker Listings and uploading other related files.
b. Each Job Seeker agrees that it is at least 18 years old, and that Job Seeker is solely responsible for the content of the documents it posts or replies to from posted listings, as well as for any consequences from taking such actions. Should the information posted by Job Seeker is deemed inaccurate or false, the Job Seeker takes full responsibility and liability for that information or resulting actions and releases and indemnifies Provider from liability towards the Employers. The site cannot be used for commercial reasons by the Job Seekers.
c). Job Seeker agrees that the information it posts on the Job Board or email Forms on the Job Board is accurate and represents the true and correct identity of that Job Seeker.

4. Employers
a. Employers are granted a limited, terminable, non-exclusive right to utilize this Job Board for the sole purpose of seeking employees and job candidates, replying to Job Seeker Listings by potential employees, posting Job Opportunity Listings and uploading other related files. Employers may be communicated to by Job Seekers, Visitors and other Employers by the email forms on the website as well as by personal external outreach.
b. Employers will post available job positions and also be the recipients of the responses, information, profiles, job applications, and e-mails from the interested candidates and Job Seekers. Any Job Opportunity Listing posted by an Employer will adhere to the legalities, laws, policies, discriminatory practices, and limitations of that State in which associated Job Opportunity and Employer resides, and Employer hereby releases, indemnifies and holds harmless the Job Board and Provider from actions by any state agency, third party entity, or other User resulting from such Job Opportunity Listing.
c. Employers shall abide by all local, state, and federal laws with regard to hiring and employment. Such Users agree not to and are prohibited from posting franchise, pyramid schemes, “club memberships,” distributorships, or sales representative agency arrangements or any other “opportunities” including, but not limited to those requiring Users to pay an up-front or periodic payment or recruitment of other members, sub-distributors or sub-agents.
d. Employers who post Job Opportunity Listings will provide accurate job-related and company information on the Job Board. Any positions and jobs posted by Employers must correspond to real job positions in the respective entities, with such positions being in line with the law, good faith and morality.

5. Provider
a. The Job Board is provided by Provider for the usage of Users as a free service. However, if a User has caused damage to the Provider by giving false or inaccurate information, then User bears the obligation to indemnify Provider.
b. The Provider has the right to change the Free usage policy and to begin charging Users. In the event of such circumstances, Users would have the option to continue utilizing the Job Board or cancel their account(s).
c. Due to the nature of the services, the Provider is not liable for the interruption or delay in the provision of services that is caused due to the interruption of the connection with the Internet Service Providers (ISPs), or for fault any technical reason, including but not limited to, Provider or Job Board error, improper operation of the Internet, or of the Internet Service Providers (ISP) or hosting company. In any circumstance, the Provider will not be liable to Users above any fees paid to Provider by Users. Additionally, it is agreed that Provider is not liable to Users from losses resulting from any computer viruses or worms deemed to originate from the Job Board, Provider, or other Users of the Job Board.
d. The Provider has the right to cease to host or maintain the Job Board at any time without any further obligation or liability to Users. Additionally, Provider has the right to withdraw the information that has been saved in the Job Board by Users for any reason, intentionally or not. Furthermore, Provider has the right to temporarily cease the function of the Job Board in order to perform improvements or amendments in its function.
e. In no event shall the Provider or its officers or employees be liable for any direct or indirect or consequential or purely economic loss whatsoever regardless of whether such losses are foreseeable and whether or not they are caused by Provider's negligence arising out of or in connection with the use, maintenance, or functionality of the Job Board.
f. The Provider disclaims all warranties as to the accuracy of the information contained in any of the materials in the Job Board and as such, undertakes no liability for such information.
g. The Job Board is provided "as is". The system is used exclusively within the Users own responsibility, and the Provider has no relation with the recruitment that takes place based on information that is exchanged between the Job Board Users.
h. In order to facilitate the user experience, the Job Board may "host" hyperlinks to other Websites; however, there is no liability to the Provider for the content of those Websites and for their proper function. The potential connection with such Websites is solely the Users' responsibility.
i. In case of breach of any of these Terms and Conditions of Use by any User, the Provider has the right to cease the User’s usage of the Job Board and cancel or freeze the User’s account without returning fees paid by User, if any, and without prejudice to its rights.

6. Other Agreements.
a. All intellectual property rights associated with the elements of the service and displayed on the Job Board comprising or available, including without limitation the copyright, database right, trademarks and patents, know how, confidential information and personal information collection and all other elements of the Job Board are owned or controlled by the Provider or as otherwise stated. An exception to this statement is for all documents posted on the Job Board by Users, in accordance with these terms and conditions.
b. The Job Board and AptShopper.com are protected by the appropriate technological security measures for the security of data according to the applicable specifications for Internet systems. Any attempt of an illegal or undesirable breach will be considered as a breach of the confidentiality of transactions will be examined and evidenced fully by the Provider and a prosecution will be initiated for civil and/or penal liability.
c. Subject to the terms and conditions of this Job Board, Users are permitted to make transient copies in RAM and on a monitor of the contents of the Job Board for the viewing purposes. However, Users may not permanently store any part of the Job Board (except for printing a reasonable number of pages) unless the Job Board contains an expressed invitation or permission to do so. Users may not publish any of the contents of the Job Board for any purpose.
d. Users may not make the content from the Job Board available without the permission from Provider. Furthermore, Users may not use the name, trademark, logo, domain name or any other protected item unless expressly permitted by Provider. All rights of the Provider and any third parties not expressly given are hereby expressly reserved. However, Users do have permission from Provider to insert the Job Board URL link on the website of User or other third-party websites.
e. The invalidity or unenforceability for any reason of any part of this agreement will not prejudice or affect the validity or enforceability of the remainder.
f. The Provider reserves the right to make changes to the terms and conditions applicable to the use of this Job Board at any time. Such changes will be posted to this site, and it is the Users’ responsibility to check to see whether any changes have been posted.
g. These Terms and Conditions of Use remain in effect during that time while a User utilizes the Job Board, and for registered Users, as long as their account remains open. Users may delete an account at any time. Provider has the option to suspend or terminate any User’s account or their access to parts of the Job Board, for any or no reason, without notice to User. Provider will have no liability whatsoever to User for any termination of the User’s account or related deletion of User’s information. All provisions of these Terms and Conditions shall survive termination or expiration of the Users having an active account account except those provisions granting the User access to and usage of the Job Board.
h. The Provider and Job Board make no warranty, guarantee, or representation as to the accuracy, sufficiency, or security of information posted or transmitted by Users and assumes no responsibility or liability in connection with the use or misuse of such information. Provider assumes no liability or responsibility for the quality, safety, or legality of the employment opportunities or biographical information posted, the truthfulness or accuracy of the listings, the ability of employers to offer employment opportunities to candidates or the ability of candidates to fill job openings. NEVERTHELESS, Provider retains the right to monitor posted information and to remove material or messages that it believes are obsolete or are not in the best interest of the Provider or Job Board.
i. The Provider, its officers, directors, employees or agents assume no liability or responsibility for any damages whatsoever (including, but not limited to, lost profits, job opportunities, or damage resulting from lost data or business or employment interruption), resulting from the usage of the Job Board, its forms or related features, whether based on warranty, contract, tort, or other legal theory, and whether or not the User is advised in advance of such potential damages.
j. These terms and conditions shall be governed in all respects by the laws of the State of Louisiana regardless of its choice of law rules. In addition, users consent to be subject to the exclusive jurisdiction of the state and federal courts of Louisiana in the event of any dispute between the parties.
